Thrive Work Recruitment Ltd – Terms of Business (Employers)

These Terms of Business (“Terms”) apply to all recruitment and talent-sourcing services provided by Thrive Work Recruitment Ltd (“Thrive Work”, “we”, “us”, or “our”) to the Client (“you”, “your”).
By instructing Thrive Work, requesting CVs, interviewing any Candidate introduced by us, or engaging a Candidate (directly or indirectly), you agree to be bound by these Terms.
1. Definitions
Candidate – any person introduced by Thrive Work to the Client, whether directly or indirectly.
Client – the company or individual who engages Thrive Work’s services.
Engagement – employment, contract, consultancy, freelance, or any work arrangement offered to a Candidate.
Remuneration – total annual salary plus any contractual benefits, bonuses, commissions, allowances, or guaranteed payments.
Introduction – provision of CVs, profiles, or arranging interviews with Candidates.
2. Our Services
Thrive Work provides permanent, contract, and temporary recruitment services across the UK.
We introduce relevant, qualified Candidates based on your vacancy brief, job requirements, and organisational needs.
3. Fees (Permanent Placements)
Our standard permanent recruitment fee is:
18% – 22% of first-year Remuneration, depending on role seniority and complexity.
The exact percentage will be confirmed for each role.
Payment Terms:
Invoices are issued on the Candidate’s start date and payable within 30 days.
4. Fees (Contract / Temporary Placements)
For contract/temporary placements, Thrive Work charges a margin on top of the Candidate’s hourly or daily rate.
Margins vary depending on skillset and market conditions and will be confirmed in writing before sourcing.
We manage timesheets, invoicing, and payments.
5. Introductions & Liability
If you engage a Candidate introduced by Thrive Work within 12 months of the introduction, our fee applies.
If you pass a Candidate to another employer or third party, and they subsequently engage the Candidate, you remain liable for the full fee.
You agree not to directly contact or recruit any Candidate outside of Thrive Work’s process during the introduction period.
6. Cancellations
If an offer is withdrawn by the Client after acceptance, the full fee remains payable.
7. Replacement Guarantee
If a permanent Candidate leaves within the guarantee period for reasons other than redundancy, business closure, or substantial role change, Thrive Work will provide a free replacement search.
Guarantee period: 8–12 weeks, depending on the role.
This guarantee applies only if:
invoice is paid on time,
the Candidate was not dismissed for unlawful reasons,
the working conditions match those offered at acceptance.
No refunds are provided.
8. Client Responsibilities
You agree to:
Provide accurate role requirements and vacancy details.
Notify Thrive Work immediately when an offer is made or accepted.
Inform us of the Candidate’s start date and first-year Remuneration.
Pay invoices within 30 days.
9. Candidate Data & GDPR
You agree to handle all Candidate data in compliance with the UK GDPR.
You must not use Candidate data for any purpose other than assessing suitability for the vacancy.

10. Confidentiality
Both parties agree to keep all Candidate information and commercial terms confidential.
11. Liability
Thrive Work does not accept liability for loss, cost, or damage arising from the introduction or engagement of a Candidate.
You are responsible for verifying:
references, qualifications, right to work, and suitability.
any background checks required for the role.
12. Variation
Any variation to these Terms must be agreed in writing by both parties.
13. Governing Law
These Terms are governed by the laws of England & Wales.
Acceptance
By:
requesting Candidate CVs,
interviewing Candidates,
or offering employment to a Candidate,
you accept these Terms of Business.
